1. Object and definitions

These Terms and conditions ("Terms") govern the use of the website Ospite Smart and the "digital guide" service offered to users who register and purchase the package. The service consists of creating a personalized web page (dedicated subdomain) with informational content for guests of the properties (WiFi, schedules, house rules, contacts, etc.).

User / Customer: the person who registers and/or purchases the service. Platform / Service: the site, the application and the features offered by Ospite Smart.

2. Registration and account

To use the service, you must register by providing truthful and up-to-date information. The user is responsible for safeguarding their credentials and for all activities carried out through their account. You may have one account per person/property unless otherwise agreed.

3. Purchase and payment

The activation of the digital guide is subject to payment of the fee indicated (e.g. a one-time €20 payment). Payment is made through the methods made available on the site (e.g. PayPal, card via Stripe). Discount codes or coupons, if provided, are applied according to the rules shown during checkout. Once payment is completed (or a valid coupon is applied), the service is activated and the user can configure their platform and subdomain.

4. Use of the service

The user agrees to:

• use the service lawfully and in compliance with applicable laws;
• not upload unlawful, defamatory, violent content, or content that infringes third-party rights (trademarks, copyright, privacy);
• not abuse the infrastructure (e.g. excessive load, use for unauthorized purposes);
• keep the guide content up to date and accurate.

A maximum number of sections/pages per platform is allowed as specified in the offer (e.g. up to 10). The subdomain is unique and assigned based on availability.

5. Intellectual property and license

The site, the software and the Ospite Smart trademarks remain the property of the owner. The user is granted a limited, non-exclusive and revocable license to use the service. The content uploaded by the user (texts, images, documents) remains the property of the user, who ensures its ownership and grants Ospite Smart the license necessary to provide the service (hosting, display, backup).

6. Limitation of liability

The service is provided "as is". We do not guarantee that there will be no interruptions or errors. We are not responsible for indirect, consequential or punitive damages arising from the use (or inability to use) the service, except where the law does not allow the exclusion or limitation of such liability. In any case, liability is limited to the amount actually paid by the user for the service in the last year.

7. Suspension and termination

We reserve the right to suspend or terminate the account and access to the service in the event of violation of these Terms, unlawful or abusive use, or for technical/legal requirements. The user may stop using the service at any time; no refunds are provided for periods already paid unless otherwise required by law or a specific agreement.

8. Modifications

We may modify these Terms. Changes will be published on this page along with the update date. Continued use of the service after publication constitutes acceptance of the new terms. In case of material changes, we may notify users by email or notice in the reserved area.

9. Applicable law and competent court

These Terms are governed by Italian law. For any dispute, the competent court is the court of the consumer’s place of residence or, for non-consumer users, the court of the service owner’s registered office.
